Terms of Service

1. ACCEPTANCE OF TERMS
By accessing the website or booking services with Clicks by Nik, you agree to be bound by these Terms of Service and all applicable laws in the State of Louisiana.

2. INTELLECTUAL PROPERTY & COPYRIGHT

• Ownership: All images captured by Clicks by Nik remain the sole property of the Photographer under U.S. Copyright Law.

• Usage License: Upon full payment, Client is granted a personal, non-commercial license to print and share images.

• Prohibitions: Client may not sell images to third parties, enter them into contests, or apply heavy filters/edits that alter the Photographer’s work without written permission.

3. DIGITAL GALLERY & STORAGE

• Delivery: Photos are delivered via a digital gallery.

• Storage Period: Clicks by Nik will host the gallery for [30/60/90] days. It is the Client’s responsibility to download and backup all files within this window. Photographer is not liable for lost files after the gallery has expired.

4. CONDUCT ON-LOCATION

• Safety: For sports and on-location shoots, Clicks by Nik reserves the right to stop a session if conditions become unsafe or if the Photographer is subjected to harassment.

• Cooperation: Photographer is not responsible for missed shots due to lack of cooperation from subjects or interference from "guest photographers" (friends/family with phones).

5. REFUND & RE-SHOOT POLICY
Due to the custom nature of photography, all sales are final. Re-shoots are at the sole discretion of Clicks by Nik and are generally only offered in the event of major technical equipment failure.

6. INDEMNIFICATION
You agree to indemnify and hold Clicks by Nik harmless from any claims, damages, or legal fees resulting from your breach of these terms or your conduct during a photography session.

7. GOVERNING LAW
Any disputes arising from these terms will be handled in accordance with the laws of the State of Louisiana, specifically within the jurisdiction of Iberville Parish.
